Competition and Prize Promotion Terms & Conditions

These General Terms and Conditions apply to all prize draws, competitions, giveaways and promotional prize activities run by Elan Skincare Ltd, unless separate promotion-specific terms are provided.

From time to time, Elan Skincare may run prize promotions through the Elan Skincare website, email marketing, Facebook, Instagram or other official Elan Skincare channels.

By entering a prize promotion, you agree to be bound by these Terms and Conditions, together with any promotion-specific terms stated in the relevant promotional post, page, email or campaign.

The promoter is Elan Skincare Ltd, a company registered in England and Wales under company number 10968768.

1. Eligibility

Prize promotions are open to UK residents aged 18 or over, unless otherwise stated in the promotion-specific terms.

Employees, contractors, agents or representatives of Elan Skincare Ltd, their immediate family members, and anyone professionally connected with the promotion are not eligible to enter.

Elan Skincare may require entrants or winners to provide proof of identity, age, address and eligibility.

2. How to enter

The method of entry, opening date, closing date, prize details, number of winners and any specific eligibility requirements will be set out in the relevant promotional post, page, email or campaign.

Unless otherwise stated, no purchase is necessary to enter.

Only one entry per person is permitted unless the promotion-specific terms state otherwise. Entries submitted on behalf of another person will not be accepted.

Entries must be submitted in the format requested. Incomplete, late, incorrect, fraudulent, bulk, automated or duplicate entries may be disqualified.

Elan Skincare accepts no responsibility for entries that are lost, delayed, misdirected, corrupted, incomplete or not received for any technical, delivery or other reason. Proof of sending an entry is not proof of receipt.

3. Winner selection

For prize draws, winner(s) will be selected at random from all valid entries received before the closing date.

For competitions involving skill, judgement or creativity, winner(s) will be selected according to the judging criteria stated in the promotion-specific terms.

Elan Skincare’s decision is final and binding. No correspondence will be entered into regarding the result, except where required by law or applicable promotional rules.

4. Winner notification

Winner(s) will be contacted using the contact details or social media account provided at the time of entry, unless otherwise stated.

Winner(s) must respond within seven working days of being notified. If a winner does not respond within this period, is ineligible, cannot be contacted, or fails to provide the information reasonably required to arrange delivery of the prize, Elan Skincare reserves the right to select an alternative winner.

5. Prizes

Prizes are as stated in the relevant promotion and are subject to availability.

Prizes are non-transferable, non-refundable and cannot be exchanged for cash or any other alternative.

Elan Skincare reserves the right to substitute a prize with another prize of equal or greater value if circumstances beyond its reasonable control make this necessary.

Unless expressly stated, any costs or expenses not specifically included as part of the prize are the responsibility of the winner.

Elan Skincare accepts no responsibility for prizes that are lost, damaged or delayed in transit, except where this is caused by Elan Skincare’s negligence.

6. Disqualification

Elan Skincare reserves the right to disqualify any entrant who:

• breaches these Terms and Conditions;
• provides false, misleading or incomplete information;
• uses multiple accounts, automated entry methods or bulk-entry tools;
• acts fraudulently, unfairly or in a way that damages the integrity of the promotion;
• posts offensive, unlawful, harmful or inappropriate content in connection with the promotion.

7. Use of entries and content

You confirm that any content you submit as part of a competition or prize promotion is your own original work and does not infringe the rights of any third party.

You retain ownership of your entry and any intellectual property rights in it. However, by entering, you grant Elan Skincare a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, share and display your entry for the purpose of administering the promotion and promoting Elan Skincare, including on its website, email marketing, social media and other marketing channels.

Elan Skincare will not use your image, name, likeness or personal story in paid advertising without seeking any additional permission required by law.

8. Publicity

By entering, you agree that Elan Skincare may announce the winner’s name and/or social media handle in connection with the promotion.

Where required by applicable promotional rules, Elan Skincare may make limited winner information available on request, such as the winner’s surname and county, unless the winner objects or requests that this information is reduced for valid reasons.

9. Personal data

Elan Skincare will process personal data provided by entrants for the purpose of administering the promotion, contacting winner(s), verifying eligibility, arranging prize fulfilment and complying with legal or regulatory obligations.

Personal data may be shared with third-party service providers where necessary to administer the promotion or deliver the prize, such as delivery companies, fulfilment partners, email platforms or social media platforms.

Elan Skincare will not use your details for direct marketing unless you have separately opted in to receive marketing communications.

Personal data will be handled in accordance with Elan Skincare’s Privacy Policy.

10. Social media promotions

Where a promotion is run on Instagram, Facebook or any other social media platform, the promotion is not sponsored, endorsed, administered by, or associated with that platform.

By entering a social media promotion, entrants release the relevant platform from any liability connected with the promotion, to the fullest extent permitted by law.

Entrants must not inaccurately tag themselves or others in content connected with a promotion.

11. Changes, cancellations and events outside our control

Elan Skincare reserves the right to cancel, amend, suspend or withdraw a promotion where it becomes necessary to do so due to circumstances beyond its reasonable control, or where the promotion cannot be run fairly, safely or lawfully.

Any changes will be communicated as clearly as reasonably possible.

12. Liability

Nothing in these Terms and Conditions excludes or limits Elan Skincare’s liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to the above, Elan Skincare will not be liable for any loss, damage, injury or disappointment suffered by any entrant as a result of entering a promotion or accepting a prize, except where caused by Elan Skincare’s negligence or breach of legal duty.

13. Governing law 

These Terms and Conditions are governed by the laws of England and Wales.

Entrants agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising in connection with these Terms and Conditions or any Elan Skincare prize promotion.
